Terms of Service – DaDesktop Public Cloud

Purpose

Our remote desktops are intended solely for delivering training courses, consultancy, or recruitment.

Prohibited Uses

The following activities are not allowed:

  1. Hosting websites or other services
  2. Mining Bitcoin
  3. Running performance tests

Should our team notice any of these activities, we'll immediately stop the service and no refund will be given.

 

Service Guarantee and SLA

We commit to keeping the service available 95% of the time.

Any maintenance, repairs, or updates will happen outside hosted working hours, specifically between 8 am and 8 pm local time in Germany (the server's physical time zone).

 

Data Protection and Confidentiality

This service is provided without any guarantees regarding the confidentiality or security of information transferred to the desktops. If you need that, consider opting for DaDesktop On-Premise.

Since these desktops are mainly intended for training, they aren't appropriate for handling highly sensitive content.

Logging in to the remote desktops prioritises ease of use rather than robust security.

Recording for Troubleshooting

Course desktops—including fresh-start, trainer, and participant instances—might be captured to help diagnose issues.

Liability Disclaimer and Indemnification

DaDesktop supplies the services on an 'as is' and 'as available' basis, with all imperfections. Neither we nor our suppliers offer any express or implied warranties or guarantees about the services. To the fullest extent allowed by law, we and our suppliers reject implied warranties of merchantability, satisfactory quality, accuracy, fitness for a specific purpose or need, and non-infringement. We and our suppliers do not promise that the results you achieve from using the services will be effective, reliable, accurate, or match your expectations. We also do not guarantee that you’ll be able to access or use the services (directly or via third‑party networks) at the times or places you prefer. No statement, whether spoken or written, from any DaDesktop representative can create a warranty. You might have extra consumer rights under your local laws in Germany that this agreement cannot override. You use the services entirely at your own risk.

Your only and exclusive remedy for any issue with us or our suppliers is to cancel your account. Under no circumstances will our, our affiliates’, and our suppliers’ total combined liability to you for any claims related to your use of the services go beyond the total fees you paid (if any) during the period in which those claims arose. We, our affiliates, and our suppliers are not liable for any indirect, special, incidental, consequential, or exemplary damages resulting from your use of, or inability to use, the services.
